Terms & Conditions - Resident OPT IN Program

Water Matrix Condominium Fixture Installation Program:

This Agreement governs the supply and installation of plumbing fixtures within a private condominium unit as selected by the participating unit owner or resident (“Customer”).

Participation in the Water Matrix Fixture Selection Program is voluntary. The Customer agrees that all fixtures selected through the Water Matrix Fixture Selection Form (hard copy or electronic), once submitted and paid for, form part of this Agreement and authorize Water Matrix Inc. (“Water Matrix”) to supply and install the selected equipment in the Customer’s unit.

Fixtures available through this program may include, but are not limited to:

  • Toilets

  • Showerheads

  • Tub spouts

  • Mixing valves

  • Faucets

  • Related plumbing fixtures

Installation will proceed upon confirmation of successful payment to Water Matrix, typically within 30 days. Some exceptions may apply.

EQUIPMENT STANDARDS

All fixtures supplied through this program shall be Original Equipment Manufacturer (OEM) products supplied directly by approved manufacturers.

The contracted price includes standard installation, as defined by fixture type below.

STANDARD INSTALLATION SCOPE

Standard Toilet Installation Includes

  • Supply and delivery of new toilet fixture (bowl, tank, seat, and lid)

  • Removal and environmentally responsible disposal of the existing toilet

  • Disposal of packaging from the new fixture

  • Supply and installation of:

    • braided stainless steel supply line

    • wax gasket

    • brass mounting bolts

    • decorative bolt caps

  • Installation of shims where required to stabilize the toilet on uneven flooring

  • Application of silicone sealant where necessary to minimize movement or rocking

Toilet Installation Limitations

In certain situations, standard installation may not be possible without additional plumbing repairs. These may include, but are not limited to:

  • damaged or deteriorated toilet flanges

  • failed or non-functioning shut-off valves

  • compromised mounting hardware

  • other unforeseen plumbing deficiencies

Where such conditions are identified, the Customer agrees that repairs listed in Schedule A may be required and will be billed accordingly.

Once an existing toilet has been removed, Water Matrix will not reinstall the removed toilet onto a damaged or defective flange, as doing so may lead to leakage or water damage. Repair or replacement of the flange will therefore be required before installation of the new fixture.

Standard Showerhead, Tub Spout, and Mixing Valve Installation Includes

  • Supply and delivery of the selected fixture

  • Removal and disposal of the existing fixture and packaging

  • Installation of the new fixture using standard installation materials that may include:

    • plumber’s thread tape

    • mounting hardware

    • brackets or rails where applicable

    • adhesive materials where applicable

    • shower arms where applicable

  • Connection of tub spouts and mixing valves to existing plumbing infrastructure

Installation Limitations

In some instances, existing showerheads or plumbing components may be seized and cannot be removed without risk of damage.

If removal is not possible, the Customer may choose to:

  • retain the purchased fixture at a discounted price reflecting the removal of installation services ($5–$15), or

  • receive a full credit for the fixture.

Standard Faucet Installation Includes

  • Supply and delivery of the selected faucet fixture and supply lines

  • Installation of hot and cold supply lines connecting the faucet to existing plumbing

Installation Limitations

Certain faucet designs require pre-drilled countertop holes or specific mounting configurations.

Water Matrix does not drill or modify countertops to accommodate new faucet configurations.

Where existing plumbing requires modification or upgrade in order to complete installation, additional charges listed in Schedule A may apply.

Where installation cannot proceed due to failed shut-off valves or isolation valves within the suite, the Customer may choose to:

  • retain the faucet at a discounted rate reflecting removal of installation services ($10–$20), or

  • receive a full credit for the fixture.

WATER MATRIX RESPONSIBILITIES

Water Matrix will ensure that work areas are reasonably cleaned following completion of the installation.  This includes:

  • removal and disposal of all packaging materials

  • cleanup of water or debris generated during installation

  • removal and disposal of fixtures removed from the suite

SERVICE REQUESTS AND WARRANTY

The Customer must notify Water Matrix immediately if post-installation deficiencies are identified.  Water Matrix will not be responsible for costs associated with third-party contractors engaged by the Customer to repair or modify Water Matrix installations without prior notice.  Service requests must be submitted through the Water Matrix service line: 1-888-859-8859  Water Matrix guarantees installation labour for a period of one (1) year following installation.  All fixture warranties are provided solely by the manufacturer and can be processed through Water matrix Inc.

MANUFACTURER WARRANTIES

Hennessy & Hinchcliffe Toilets

  • Lifetime vitreous china warranty covering fading and discoloration

  • 10-year Air Transfer (BSB) system warranty

  • 1-year warranty on components including seats, valves, and handles

Niagara Showerheads & Faucets

  • 10-year replacement warranty against manufacturing defects

EXISTING BUILDING OR SUITE CONDITIONS

Water Matrix is not responsible for the repair or future failure of existing building plumbing infrastructure including but not limited to:

  • riser shut-off valves

  • isolation valves

  • sanitary piping

  • building plumbing systems

Water Matrix is also not responsible for removing or cleaning stains, discoloration, or markings revealed when existing fixtures are removed. Where the footprint of a newly installed fixture is smaller than the previously installed fixture, Water Matrix may offer optional cosmetic covers where available, including:

  • Toilet shoe cover – $25 (see Schedule A)

UNSAFE OR UNSANITARY CONDITIONS

Water Matrix technicians reserve the right to refuse service where suite conditions pose health or safety risks including, but not limited to:

  • insect infestations

  • bed bugs

  • hoarding conditions

  • excessive waste or debris

  • aggressive animals

  • hazardous environments

Installation may proceed once the suite is deemed safe for entry.

CANCELLATION POLICY

Customers may cancel their fixture installation up to four (4) business days prior to the scheduled installation date without penalty.  Cancellations made after this period will incur the following fees:

Fixture Cancellation Fee

Toilet - $75 + tax

Showerhead - $25 + tax

Faucet - $35 + tax

RESCHEDULING

If a Customer requests to change their scheduled installation date without providing four (4) business days notice, a rescheduling fee of $10 for showers, $20 for faucets and $50 for toilet .  Water Matrix will make reasonable efforts to accommodate a new installation date within the property's overall installation schedule.   Where rescheduling requires a separate return visit outside the site schedule, an additional service visit fee will apply and will be quoted at the time of request for date change.

REBATES

Where applicable, Water Matrix may assist the condominium corporation with bulk rebate applications related to water efficiency programs.  Water Matrix does not submit rebate applications on behalf of individual residents.  Water Matrix is not responsible for municipal rebate approvals, processing, or payment.  All rebate matters remain solely between the Customer and the applicable municipality.  Failure to receive a rebate does not constitute grounds for cancellation or non-payment.

SCHEDULE A

Additional Installation Charges (If Required)

The following items may be required where existing plumbing conditions prevent standard installation.  Charges apply only when necessary to safely complete the installation or prevent potential water damage.

Extra Items Pricing

Double Wax Gasket - $7.50 + tax

Flange Anchor or Reinforcement - $20.50 + tax

Complete Toilet Flange Replacement - $125 + tax

Piggyback Shut-Off Valve Installation - $45 + tax

Shut-Off Valve Replacement - $95 + tax

Optional Toilet Shoe Cover - $25 + tax

Where additional work listed in Schedule A is required, the Customer agrees that the work will be completed and the associated costs will be billed to the Customer upon completion of the installation.

CONDOMINIUM CORPORATION NON-PARTICIPATION AND NON-COOPERATION

The Customer acknowledges and agrees that the services provided under this Agreement are offered solely by Water Matrix Inc. and are contracted directly between the Customer and Water Matrix Inc. The Condominium Corporation, including its Board of Directors, officers, employees, property manager, and property management company, is not a party to this Agreement and has no contractual relationship with Water Matrix Inc. in relation to the services performed within individual units under this program.

The Customer further acknowledges that the Condominium Corporation’s role, if any, is limited strictly to permitting communication regarding the availability of the program to residents. Such communication shall not be interpreted as an endorsement, recommendation, supervision, or participation in the services being provided.

INDEMNIFICATION, RELEASE, AND VOLUNTARY PARTICIPATION

The Resident or Unit Owner (“Customer”) acknowledges and agrees that participation in this program is entirely voluntary and is undertaken at the Customer’s sole discretion. The Customer further confirms that their decision to participate has been made independently and without solicitation, persuasion, direction, or influence from the Condominium Corporation, its Board of Directors, officers, employees, agents, property manager, or property management company.

The Customer expressly acknowledges that the Condominium Corporation has no ownership, operational role, supervisory role, or contractual involvement in the services being provided. The services contemplated under this program are provided solely by Water Matrix Inc., and any agreement for services is strictly between the Customer and Water Matrix Inc.

The Customer agrees to fully indemnify, defend, and hold harmless the Condominium Corporation, its Board of Directors, officers, employees, agents, property manager, and property management company (collectively, the “Released Parties”) from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses, including but not limited to legal fees on a full indemnity basis, arising directly or indirectly from:

  • the installation, repair, replacement, modification, or servicing of plumbing fixtures or equipment within the unit;

  • any alleged or actual defect, malfunction, or failure of fixtures or equipment;

  • any water damage, property damage, personal injury, loss of use, or consequential damages;

  • the actions, omissions, negligence, or workmanship of Water Matrix Inc. or any of its contractors, employees, or representatives; and

  • the Customer’s participation in this program.

The Customer further agrees that the Condominium Corporation and the Released Parties shall bear no responsibility or liability whatsoever for the performance of the work, quality of materials, scheduling of services, or any outcomes related to the services provided by Water Matrix Inc. By accepting these terms and conditions, the Customer confirms that they release the Released Parties from any present or future claims related in any way to this program or the services provided, and that the Condominium Corporation’s involvement is limited solely to communicating the availability of the program as a convenience to residents.
